Madras High Court: The Madras High Court has held that the Central Election Commission is responsible for the current expansion of COVID-19. The court also ruled that the commission should be charged with murder for irresponsible conduct.

The first bench of Chief Justice Sanjeeb Banerjee and Justice Senthilkumar Ramamurthy criticized the Election Commission for not preventing political parties from violating the COVID protocols. “You are solely responsible for the current situation,” he told the Madras High Court.

“You have no restrictions on the exercise of any kind of authority. The High Court observed that despite the court order to protect the COVID protocol, “you have not taken any action to prevent political parties from holding election rallies”. The court also asked whether the Election Commission was on another planet during the election rallies.

The court was hearing a petition filed by state transport minister MR Vijayabhaskar seeking action to prevent crowds in his constituency of Karur on May 2, when the counting of votes will take place. A total of 77 candidates contested from Karur.

The court said “survival and protection” are important now and “everything else comes after that”. The court said the ECI would issue an order suspending the counting of votes if it failed to prepare a draft to ensure compliance with the code of conduct before the counting day before May 2.

“The counting of votes on May 2 should not be a catalyst for further leaps and bounds. Public health is paramount. It is unfortunate that the constitutional authorities have to be reminded of this, ”the court said.

The case is set to return to court on April 30.
